This bill, known as the Defend the Guard Act, restricts the deployment of the Kentucky National Guard into "active duty combat," which is defined as participating in armed conflict or performing hazardous duties related to armed conflict in a foreign country. Such deployments are only permitted if Congress officially declares war, or takes specific constitutional action to call forth the Guard for enumerated purposes like executing laws, repelling invasions, or suppressing insurrections, and any outstanding financial obligations to the Guard are met. However, the bill allows the Governor to consent to the deployment of the Kentucky National Guard under Title 32 of the United States Code, which governs the National Guard's status when not in federal service, for up to 30 days to assist in border protection if a state or territory's governor declares an invasion, or for other civil authority missions within the United States or its territories.
