This bill amends Kentucky law to require background checks for private firearms sales or transfers, with exceptions for sales conducted by federally licensed dealers or transfers within an immediate family (spouses, parents, children, and stepchildren). Before any such sale or transfer, a national instant background check must be completed by a dealer who agrees to conduct it, and the dealer must then complete a form from the Kentucky State Police confirming the check. Dealers must keep records of these transactions and checks on their premises, available for inspection by law enforcement, and can charge a fee of up to $10 for each background check. Records of these transactions will not be considered public records. Violating this new requirement will be a Class A misdemeanor, meaning a person could face up to a year in jail and a fine of up to $500.
