Bill Summary

Electricity rate increases due to data centers. Provides that the Indiana utility regulatory commission may not approve an increase in the rates and charges of an electric utility to the extent the increase is related solely to the electric utility's cost of providing electric utility service to: (1) a data center; or (2) a new or existing facility: (A) the electricity demand of which exceeds or will exceed a specified amount; and (B) that employs or will employ fewer than 50 full-time employees on the premises of the facility.

AI Summary

This bill prohibits the Indiana Utility Regulatory Commission (IURC), which is the state agency that oversees utility rates, from approving rate increases for electric utilities if those increases are solely due to the costs of providing electricity to a data center or to a new or existing facility that uses a significant amount of electricity (more than 5% of the utility's average peak demand over the last three years, or 150 megawatts, whichever is less) but employs fewer than 50 full-time workers on-site. This aims to prevent the general customer base from subsidizing the electricity costs of large energy-consuming facilities that do not contribute significantly to local employment.
