This bill aligns state and local government procurement laws with federal regulations by prohibiting the purchase of certain technology, including hardware, software, and services, that are deemed a security risk to the state or nation, specifically those prohibited under Section 889 of Public Law 115-232. The Office of Information Technology Services (ITS) is now responsible for creating and maintaining a list of restricted technology, consulting federal sources and other relevant information to identify items that pose a security threat. Waivers for procurement of restricted technology can be granted by ITS in consultation with other agencies if it's in the state's interest, no compliant alternatives are available at reasonable prices, and the waiver won't compromise network security. The bill also clarifies the definition of "technology" for procurement purposes and includes specific provisions for unmanned aerial vehicles, ensuring data collected is stored domestically and not accessible to restricted entities, while also encouraging domestic manufacturing. Importantly, existing technology in use before the bill's effective date is not required to be removed or replaced.
