This bill amends a Kentucky law (KRS 23A.080) to grant the state the right to appeal certain decisions made by the District Court in criminal cases to the Circuit Court. Previously, the state's ability to appeal adverse rulings in criminal matters was more limited. Under this new provision, the state can appeal if the District Court makes a decision or ruling against the prosecution, but this appeal will not halt the ongoing court proceedings. The appeal must follow established rules for criminal and appellate procedures, and if the Circuit Court finds the District Court's decision was incorrect and a new trial would not violate the defendant's constitutional rights, such as protection against double jeopardy (being tried twice for the same crime), it can order a new trial.
