This bill establishes new provisions for when the Attorney General files a public nuisance action, which is a lawsuit to address a condition that interferes with the public's right to use or enjoy property, or a consumer fraud action, which is a lawsuit to stop deceptive business practices. Specifically, if either of these actions is dismissed by a court or found to lack merit, and the Attorney General knew or should have known it lacked a sufficient legal or factual basis, or if the Attorney General publicized the filing of the action, then the Attorney General would be liable for damages to any person injured by the action. These damages would include reasonable attorney fees and litigation costs, and the Attorney General would also have to pay a civil penalty equal to three times the amount of the defendant's damages, which for businesses could include lost sales, profits, and business value. Any damages and penalties awarded would be paid from the Attorney General's general operating fund.
