This bill, effective May 6, 2026, prohibits public employee insurance, which is group health insurance offered by government employers like state agencies, political subdivisions, or higher education institutions to their employees and their dependents, from covering or paying for hormonal transgender treatments, primary sex characteristic surgeries, or secondary sex change characteristic surgeries. However, there are exceptions: individuals already undergoing hormonal transgender treatment before May 5, 2026, can continue and complete that treatment under the same terms if a physician deems it medically necessary, and if public employee insurance previously paid for such treatments or surgeries before May 6, 2026, to transition someone from their biological sex, the insurance must offer similar coverage to help restore that individual to their biological sex. Furthermore, the state will defend and cover legal costs for individuals acting to enforce these provisions if their own insurance doesn't cover such claims.
