This bill modifies the offense of delivery of a controlled substance causing death by removing the requirement that the person delivering the drug must have known it was mixed with another controlled substance. Under the proposed changes, if someone delivers or distributes a controlled substance, and a death results from its use, they can be charged with this offense, which is a Class A felony, regardless of whether the user contributed to their own death. A controlled substance, for the purposes of this law, refers to substances listed in Schedule I or Schedule II as defined in section 195.017.
