This bill modifies Vermont's laws regarding operating a vehicle under the influence of alcohol or other substances by clarifying the definition of "under the influence" to include impairment by alcohol, drugs other than alcohol, or a combination of both, and expanding the types of evidentiary samples that can be collected with a warrant to include saliva in addition to blood. It also adjusts the penalties for repeat offenders, specifically for second, third, and fourth or subsequent offenses of driving under the influence, by refining the look-back period for previous convictions to the 20 years preceding the date of the current violation and, in some cases, requiring a minimum amount of consecutive jail time that cannot be suspended or deferred, with exceptions for successful completion of residential alcohol treatment programs.
