This bill, known as the "Kratom Consumer Protection Act," establishes new regulations for the sale of kratom products in Missouri. It defines "dealer" as anyone who sells, prepares, or advertises kratom, and "kratom" as any product containing parts of the Mitragyna speciosa plant. The bill requires dealers to disclose the factual basis for any representations made about their kratom products. It prohibits the sale of kratom that is adulterated or contaminated with dangerous non-kratom substances, including those listed in section 195.017, or that contains synthetic alkaloids. Additionally, it sets a limit of two percent for 7-hydroxymitragynine in the alkaloid fraction and mandates that product labels include the amounts of mitragynine and 7-hydroxymitragynine. The bill also prohibits selling kratom to individuals under twenty-one years of age. Violations of disclosure requirements are considered infractions, while violations of product safety or age restrictions are class D misdemeanors. Consumers can also pursue private legal action for damages resulting from violations of product safety or disclosure rules, and dealers may have a defense if they relied in good faith on representations from their suppliers.
