This bill establishes a new chapter in Indiana law that grants eligible employees the right to take unpaid leave for organ donation. An "employee" is defined as anyone working for pay, and an "employer" includes businesses with one or more employees, state agencies, and political subdivisions. A "state agency" encompasses various branches and instrumentalities of state government. To qualify, an employee must have been employed by the same employer for at least 12 months. This leave can be used for organ donation, including necessary recovery and testing, and is limited to a maximum of 30 working days per calendar year. Employees must provide their employer with at least 30 days' written notice before the leave begins. The bill also allows for the substitution of earned paid leave, excluding medical or sick leave, for this organ donation leave, and employers are prohibited from retaliating against employees for requesting or taking this leave. Importantly, if an employee is eligible for this leave and also for leave under another existing law (IC 4-15-16), they can only take leave under that other law. The bill also clarifies that employers are not prevented from offering more than 30 days of leave or providing paid leave for organ donation.
