This bill amends Pennsylvania law regarding the offense of indecent exposure, specifically changing how the crime is graded based on the age of those present and the number of prior offenses. Previously, if the offender knew or should have known that someone under 16 was present, it was a first-degree misdemeanor, and any other indecent exposure was a second-degree misdemeanor. This bill reconfigures these penalties: if the offender knows or should have known someone under 16 was present, a first offense is a first-degree misdemeanor, and a second or subsequent offense is a third-degree felony. However, for all other indecent exposure offenses, a first offense is now a second-degree misdemeanor, a second offense is a first-degree misdemeanor, and a third or subsequent offense is a third-degree felony. These changes will take effect 60 days after the bill is signed into law.
