Furthermore, platforms are prohibited from processing data or designing features that conflict with user best interests or deceive users about the AI's nonhuman nature, prioritizing transparency. Terms of service agreements must be clear, require affirmative user consent, and cannot include mandatory arbitration clauses. The Attorney General will enforce the act, with violations potentially leading to injunctions, disgorgement of unjust gains, and civil penalties of up to $10,000 per violation, while individuals can also bring civil actions for damages and injunctive relief. The bill also includes a severability clause, meaning if any part is found invalid, the rest remains in effect.
