This bill requires the Legislature to appropriate sufficient funding each fiscal year to the State Board of Education for flexible benefit allowances for school district employees. Specifically, it mandates full funding for districts providing at least 170 days of in-person instruction and a minimum benefit allowance for those with fewer instructional days, ensuring these allowances are prioritized before other school activities. The bill also clarifies that the State Board of Career and Technology Education will continue to receive appropriations for flexible benefit allowances for technology center school district employees. Flexible benefit allowances, which can be used for health insurance premiums or other eligible benefits under Section 125 of the U.S. Internal Revenue Code, will not be counted towards state retirement contributions or the minimum salary schedule for teachers, and will not be used to reduce the salary of eligible support employees. The act takes effect on July 1, 2026, and is declared an emergency measure.
