It requires ballot question committees to certify on their statements of organization that no preliminary activity was funded by foreign nationals, and their campaign statements must include a certification from the treasurer affirming that donors are not foreign nationals and have not received excessive funds from foreign nationals within a four-year period. Similarly, individuals filing independent expenditure reports for ballot questions must certify that they have not accepted excessive funds from foreign nationals. The bill also makes it unlawful for foreign nationals to contribute to, solicit for, or participate in the decision-making of ballot question committees, with significant penalties for violations, while allowing U.S.-based subsidiaries of foreign nationals to contribute if they meet specific criteria and ensuring that investigations shield the identity of lawful donors as much as possible.
