This bill requires the department to increase transparency regarding residential habilitation centers, which are facilities that provide housing and support services for individuals with developmental disabilities. Specifically, when a residential habilitation center is found to be out of compliance with the Centers for Medicare & Medicaid Services (CMS) conditions of participation or requirements, the department must notify relevant parties within 10 days. This notification must include the initial statement of deficiencies, explaining the reasons for noncompliance and its potential impact on resident safety in plain language, any established plan of correction, and subsequent determinations about the facility's return to compliance or any enforcement actions. These notices must be prominently posted at the facility in plain view of residents and visitors, in English and any requested alternative languages, and also provided in writing or email to individuals associated with residents, in their preferred language if indicated. Additionally, the department must electronically notify relevant legislative committees.
