If no specific timeframe is already established by law or regulation, agencies will have 60 days to approve or deny an application, with a possible 30-day extension under specific circumstances related to public health and safety. If an application isn't acted upon within these timeframes, it will be considered approved, unless it's incomplete or the agency provides a valid justification for the delay. The bill also establishes procedures for appealing denied licenses or permits, including administrative hearings where the agency bears the burden of proof for the denial, and guarantees applicants the right to a speedy judicial review of any final order. Importantly, these provisions do not apply to licenses or permits that are directly established or authorized by federal law, or where federal law delegates the authority to determine criteria to a state agency, if applying this bill would violate federal law.
