This bill repeals an existing law regarding unnatural and lascivious acts and creates a new law that prohibits intentionally exposing sexual organs in a lewd or lascivious manner or performing certain sexual acts while observing a child under 16 years of age for sexual arousal or gratification. The term "observing" is defined as intentionally viewing someone when the offender could reasonably be seen. This offense is classified as a third-degree felony, and it is not a defense if the child was unaware of the offender's actions or did not see the sexual organs, though exceptions exist for breastfeeding mothers and individuals in designated nude areas. The bill also makes conforming changes to other statutes related to child abuse interviews and search warrants, removing references to the repealed law, and will take effect on October 1, 2026.
