Any person who violates the provisions of the bill is subject to a civil penalty of up to $3,000 for a first violation and up to $10,000 for a second or subsequent violation. The bill provides that individuals licensed by the Board of Medicine or the Board of Nursing are subject to disciplinary action for making or knowing of certain willful representations of the care provided at such unregulated pregnancy clinics if such representations are not true.

AI Summary

This bill requires "unregulated pregnancy clinics," defined as facilities providing pregnancy-related medical care like ultrasounds but not covered by federal health privacy laws (HIPAA), to have a "qualified medical provider" (a licensed physician or advanced practice registered nurse) who supervises and is responsible for all medical care. These clinics must provide clients with the name and contact information of their supervising medical provider upon request and must also report this information to the Board of Health. Violators face civil penalties of up to $3,000 for a first offense and up to $10,000 for subsequent offenses, with penalties considering the violation's severity, the clinic's size, and its cooperation with investigations. Additionally, medical providers licensed by the Board of Medicine or Board of Nursing can face disciplinary action for making or knowing about false representations regarding the care provided at these unregulated clinics, such as falsely claiming they diagnose and treat medical conditions, that examinations are medically supervised, patient information is confidential, or that care is supervised according to medical standards.
