This bill, titled "Agriculture - Neonicotinoid Pesticides - Prohibitions," aims to restrict the use and sale of neonicotinoid pesticides, which are a class of chemicals used in pesticides. Specifically, it prohibits the distribution, sale, or use of corn, soybean, or wheat seeds treated with these pesticides, unless the Secretary of Agriculture, in consultation with environmental agencies, determines there's an insufficient supply of untreated seeds or that compliance would cause undue financial hardship to farmers, with any such suspension lasting no more than one year. The bill also prohibits the use of neonicotinoid pesticides on outdoor ornamental plants and turf, except in cases of an "environmental emergency" – defined as a pest posing a significant risk to the environment or agricultural crops, or for which preventive measures are deemed necessary by the Secretary – and only if no less harmful alternative is effective, with any temporary suspension also limited to one year. These restrictions do not apply to the production of agricultural commodities or to certified applicators treating invasive species in woody plants. The bill is set to take effect on October 1, 2026.
