This bill, known as the Fairness in Girls' Sports Act, mandates that interscholastic and intramural junior varsity and varsity athletic teams and sports sponsored by public high schools and certain nonpublic high schools must be designated based on biological sex as either boys', male, or men's; girls', female, or women's; or coeducational or mixed, with the provision that teams designated for girls, females, or women cannot include students of the male sex. Additionally, public schools and applicable nonpublic schools must designate locker rooms based on biological sex as either boys', male, or men's; or girls', female, or women's, and locker rooms used by girls' teams cannot be used by students of the male sex. The bill also states that governmental entities, licensing organizations, or athletic associations cannot take adverse action against a school for maintaining these sex-designated teams and locker rooms, and any student or school harmed by a violation of these provisions may bring a civil action seeking damages, attorney's fees, and other relief within two years of the harm.
