This bill, known as the Bowen Levy Airway Clearing Device Act, mandates that each county school board in Maryland establish a policy for public schools to ensure the availability and proper use of airway clearing devices, which are portable medical tools that use suction to remove airway blockages during choking emergencies. The policy requires each school to obtain at least one such device and authorize school nurses or other trained personnel to use it. It also specifies that these devices should be stored in areas where students and staff primarily eat, and that relevant personnel must receive training on recognizing choking symptoms and using the devices. Furthermore, the bill provides liability protection for school staff who act in good faith to assist individuals experiencing choking emergencies, unless their actions involve willful or grossly negligent behavior. Finally, the Department of Education will create a standard form for schools to report any incidents where an airway clearing device is used.
