This bill amends Maryland's procurement laws to establish a "competitive proof of concept procurement" as a formal method for state agencies to test and evaluate new goods, services, or technologies in real-world settings before full implementation or deployment. A "proof of concept" is defined as a test, evaluation, demonstration, or pilot project to determine if something can be successfully deployed and is beneficial to the State. This new procurement method can be used for testing software, innovative products, or concepts developed by state government units, and requires approval from the Chief Procurement Officer, or their designee, and for information technology procurements, the Secretary of Information Technology. The bill also clarifies that solicitations for these procurements must detail the scope of work, evaluation factors, and that vendors can be involved in subsequent phases, including full implementation, if deemed in the State's best interest. Additionally, it outlines how minority business enterprise, small business reserve, and veteran-owned small business enterprise participation goals will be handled for these specific types of procurements, and mandates that regulations for their implementation will be developed. This Act is set to take effect on June 1, 2026.
