The bill clarifies that these prohibitions do not apply to customized pricing based on cost differences or to discounts offered equally to all consumers who meet disclosed criteria, provided the consumer voluntarily provides the information for the discount. For wages, employers can set customized wages based on employee-specific data directly related to the job or the cost of living in their work location, but they must disclose to the employee what data is used and how the automated system considers it. The bill also grants the Commissioner of Labor and Employment the authority to investigate violations of these wage provisions and pursue informal resolution or legal action.
