This bill, effective November 1, 2026, allows licensed firearm dealers to enter into agreements with firearm owners to temporarily hold or store firearms. A "firearm hold agreement" is defined as a written or oral arrangement where a licensed dealer takes possession of a firearm at the owner's request and returns it according to the agreement's terms. Under this bill, a "licensed dealer" is defined as someone with the same meaning as provided in existing Oklahoma law regarding firearms. Licensed dealers are granted immunity from civil liability for actions related to taking possession of, storing, or returning a lawfully possessed firearm under such an agreement, including any injury or death occurring after the firearm is returned to the owner. However, this immunity does not apply if the dealer's actions were due to gross negligence, reckless or unlawful conduct, or if the dealer knew the firearm owner was demonstrating behavior indicating they would use the firearm unlawfully, cause harm to themselves or others, or was prohibited from owning a firearm at the time they sought to retrieve it.
