It mandates that any entity (a "covered entity") offering an AI chatbot must require users to create an account and implement a "reasonable age verification process" to determine if a user is a minor (under 18), which cannot rely solely on self-confirmation or birthdate entry, but must involve authenticated identification. If a user is identified as a minor, they must be prohibited from accessing "artificial intelligence companions," which are a type of AI chatbot designed for emotional interaction. Covered entities must also implement strong data security measures to protect age verification information, limiting its collection and retention, and prohibiting its sale or sharing. Furthermore, AI chatbots must clearly disclose that they are not human at the start of conversations and at regular intervals, and must not claim to be human or represent themselves as licensed professionals like therapists or doctors, instead advising users to consult with actual professionals for such services. Violations can result in civil penalties of up to $100,000 per violation, with enforcement actions brought by the Attorney General. This act is set to become effective on November 1, 2026.
