This bill amends existing laws concerning alternative incarceration programs and sheriff's work programs, which are options for individuals convicted of certain offenses to serve their sentences outside of traditional jail facilities. Specifically, it allows county sheriffs to implement sheriff's work programs where individuals can participate in public works projects supervised by the sheriff, in lieu of incarceration, and establishes eligibility criteria for these programs, including that the offense must be non-violent and the jail sentence no more than 30 days, with certain exceptions for repeat offenders. The bill also clarifies that prisoners participating in either alternative incarceration programs or sheriff's work programs are considered in the official custody of the sheriff for legal purposes and can receive credit towards their sentence for their participation, with one day of credit for every eight hours worked in a sheriff's work program. Furthermore, it updates language to ensure that good behavior credits against jail sentences for misdemeanors and certain felonies also apply to individuals participating in these alternative programs.
