This bill prohibits anyone from creating or using an artificial intelligence (AI) system, which refers to computer systems that can perform tasks typically associated with human intelligence like reasoning and learning, if that system is advertised or presented to the public as being a qualified mental health professional or capable of acting as one. Violating this prohibition is considered a violation of the Tennessee Consumer Protection Act of 1977, which is a law designed to protect consumers from unfair or deceptive business practices, and carries a penalty of $5,000 per violation, in addition to other remedies available under that act. The bill also specifies that this new prohibition will be added to the Tennessee Consumer Protection Act and will take effect on July 1, 2026.
