The bill prohibits any person, corporation, or entity from offering, providing, or advertising mental health services, which include peer support, counseling, therapy, or psychotherapy, that are delivered in whole or in part by AI, with limited exceptions. It also addresses the misuse of AI by mental health professionals, defining "therapeutic communication" as direct interactions intended to diagnose, treat, or support mental health, and allowing AI only for administrative support tasks like scheduling or record-keeping, provided the professional reviews and takes responsibility for the AI's output and data usage. If AI is used for transcription or recording, written consent from the patient is required, and all AI-assisted administrative tasks must adhere to confidentiality laws. Violations of these prohibitions are considered violations of the Consumer Protection Act, carrying a civil penalty of $10,000 per violation.
