This bill requires providers of educational technology products, defined as student-facing software or platforms used for teaching and learning that may collect student data, to register annually with the Secretary of State by January 31st, paying a $100 fee and providing company information, their privacy policy, and a list of their products, including which ones have been certified. The Secretary of State is tasked with creating a certification standard and review process for these products, and schools will be prohibited from using any educational technology product that has not received this certification starting July 1, 2027. The certification standards will consider factors like compliance with curriculum, educational advantages, design for educational use, specific features like geolocation or artificial intelligence, data privacy practices, and other relevant student safety and privacy aspects, with certified products needing to comply with privacy laws, clearly inform parents about data collection and usage, and restrict the collection and use of student data to only what is essential for the product's function, prohibiting sales or sharing with third parties and the creation of student profiles for non-educational purposes.
