This bill mandates that during an arrestee's initial court appearance, the judge must ask if they are a veteran of the United States armed forces, and their answer cannot be used against them in criminal proceedings unless they lie about their veteran status. If the person is identified as a veteran, the court must inform the prosecuting agency, which is the government body responsible for bringing criminal charges. Unless the veteran is charged with a serious or dangerous crime, the prosecuting agency is required to provide information about services offered by the Department of Veterans' Services and consider referring the individual to a veterans court or similar program designed for rehabilitation and diversion from traditional criminal prosecution. If a person's veteran status is disputed, they or their attorney will have the chance to provide official documentation, such as a DD-214 form, to prove their service.
