This bill, known as the "Transparency for Deepfakes in Political Advertising Act," requires that political advertisements containing "deepfakes" – which are artificially created or manipulated audio or video content that impersonates a candidate – must include a clear disclaimer. Specifically, if an audio deepfake impersonates a candidate's speech, or a video deepfake depicts a candidate engaging in actions or speech they did not actually perform, the advertisement must clearly state at the beginning and end (for audio) or for the duration (for video) that it contains fake content. These requirements apply only within 120 days of an election if the impersonated candidate is not currently in office. The bill exempts certain entities like internet service providers and broadcasters from liability if they are not responsible for creating the deepfake content, and it grants candidates who are the subject of such deepfakes the right to seek damages and other legal remedies. Violating these disclaimer requirements would be a Class C misdemeanor, a minor criminal offense.
