This bill modifies the process for individuals seeking to terminate their registration as sex offenders in California. Previously, if a district attorney requested a hearing to determine if continued registration was necessary for community safety, the petitioner was required to personally appear. This bill changes that requirement, allowing the court to order the petitioner to appear either in person or remotely via video. Additionally, when a court is deciding whether to order continued registration, this bill mandates that the court consider whether the offender held a position of trust or authority over the victim and proof of the offender's participation in or successful completion of sex offender-specific treatment. The court will also be required to verify this treatment participation or completion, and if verification is not possible, the court may order risk assessments using tools like SARATSO (State-Authorized Risk Assessment Tool for Sex Offenders) to help determine the offender's current risk of reoffending.
