This bill, concerning data centers and engine-generator sets, prohibits the Department of Environmental Quality (DEQ) from issuing an air permit for any data center application submitted on or after July 1, 2026, unless the permit's emission limits for each engine-generator set, which is a combination of a generator and an engine, meet or exceed the standards of a "Tier 4 equivalent" system. A Tier 4 equivalent system is defined as an engine-generator set equipped with specific pollution control technologies: a selective catalytic reduction system (or equivalent) for nitrogen oxides, a diesel oxidation catalyst system (or equivalent) for carbon monoxide, and a diesel particulate filter (or equivalent) for particulate matter. The bill also clarifies that this does not prevent the DEQ from imposing stricter emission limits based on established environmental control standards or from considering other regulatory requirements.
