AI Summary

This bill requires that before any individual who is not a licensed gun dealer (a person or business licensed to sell firearms) transfers a firearm at a gun show, they must ensure a background check is conducted on the prospective buyer, known as the "transferee." The transferor must also obtain approval from the Department of Public Safety after a licensed gun dealer has initiated the background check. The bill defines "gun show" as a specific type of event and clarifies that the person transferring the firearm must arrange for a licensed gun dealer to perform the background check, and the licensed dealer must follow all state and federal laws as if they were selling the firearm themselves. The transferee is prohibited from taking possession of the firearm until this approval is granted and cannot knowingly provide false information to acquire a firearm. If a firearm is transferred in violation of these rules, the transferor can be held legally responsible for any damages caused by the transferee's subsequent use of the firearm. There are several exceptions to these background check requirements, including transfers of antique firearms, gifts or loans between immediate family members, transfers due to death or by operation of law, temporary transfers for repair or maintenance, and certain short-term temporary transfers. Violating this act is a misdemeanor, punishable by jail time and/or a fine, and will result in a two-year prohibition from possessing a firearm. The bill also amends existing law to ensure the Department of Public Safety establishes procedures for conducting these background checks.
