This bill amends existing law to redefine what constitutes "reportable funding" from a "foreign adversarial source" for colleges and universities in Nebraska, with "reportable funding" being any money or its equivalent received from such sources, excluding salary, wages, or compensation. A "foreign adversarial source" is defined as a foreign adversary government or its agencies, legal entities created under their laws, citizens or nationals of such governments, or agents of these entities or individuals, with "foreign adversary" being determined by a specific federal regulation. The bill clarifies that a "contract" under this law is an agreement for acquiring property or services for the direct benefit of the foreign adversarial source, not just between the two parties. Colleges and universities in Nebraska must now report this funding biannually to the Coordinating Commission for Postsecondary Education, detailing the amount, date, purpose, source, and any associated agreements, unless federal or state law prohibits disclosure, with an exception for tuition payments from individuals who would otherwise be considered foreign adversarial sources. The commission will then make these reports publicly available on its website.
