This bill amends the Criminal Code of 2012 to consolidate "harassment by telephone" and "harassment through electronic communications" into a single offense, now called "harassment by telephone or electronic communication, or both." It expands the definition of this offense to include knowingly making a comment, request, suggestion, or proposal with the intent to harass someone, provided that the communication is not necessary for a reasonable purpose, would cause a reasonable person emotional distress, and actually causes emotional distress to the recipient. The bill also clarifies that telecommunications carriers and internet service providers are generally not liable for content transmitted by their users, except in cases of willful and wanton misconduct. Additionally, it removes a separate section of the law that previously defined "harassment through electronic communications" as a distinct offense.
