This bill amends Arizona law to classify certain renewable energy facilities as public nuisances. Specifically, it declares utility-scale wind or solar farms constructed after the bill's effective date and located within four miles of a residential property as a public nuisance, unless the facility received all necessary zoning approvals before the effective date, voluntarily obtained a certificate of environmental compatibility from the power plant and transmission line siting committee and had it approved by the corporation commission, or is a rooftop solar system. The bill also clarifies that the attorney general, rather than county or city attorneys, will be responsible for bringing legal actions to abate such nuisances. A public nuisance is generally defined as something that harms health, is indecent, offensive, obstructs property use, or interferes with the comfortable enjoyment of life or property for a community or neighborhood.
