This bill requires the Alabama Department of Human Resources (DHR) to request a waiver from the USDA Food and Nutrition Service to prohibit the purchase of candy and soda with SNAP benefits, which are financial assistance provided through the federal Supplemental Nutrition Assistance Program. Candy is defined as foods where sugar, cane sugar, corn syrup, or high fructose corn syrup is the first ingredient, excluding single-ingredient sugars for cooking, while soda is defined as beverages where carbonated water and sugar, cane sugar, corn syrup, or high fructose corn syrup are the first two ingredients, excluding those with low or non-caloric sweeteners as one of the first two ingredients. If the waiver is approved, DHR must implement the prohibition; if denied, the commissioner must resubmit the waiver request annually until approval. This act is set to become effective on October 1, 2026.
