This bill, amending Chapter 544 of the Missouri Revised Statutes (RSMo), establishes new rules for refiling dismissed criminal cases. Specifically, it allows a prosecuting attorney to refile a case if it was dismissed by the court before a preliminary hearing was held, or if the prosecuting attorney themselves dismissed it. However, if a case is dismissed for a second time, either by the court or the prosecuting attorney, the prosecuting attorney is then prohibited from refiling it again.
