Bill Summary

Mechanics' liens; liens attaching to property; memorandum of lien. Removes the exclusion of the attachment of a mechanic's lien to property improved or repaired when the lien is based on a claim for repairs or existing structures. The bill further removes (i) the ability of a lien claimant to file any number of memoranda of lien including the details relating to the lien and (ii) the provisions of the Code specifying that no memorandum filed shall include sums due for (a) labor or materials furnished more than 150 days prior to the last day labor was performed or (b) material furnished to the job preceding the filing of such memorandum.

AI Summary

This bill modifies the laws concerning mechanics' liens, which are legal claims against a property to secure payment for labor or materials provided for its improvement. Specifically, it removes an existing exclusion that prevented a mechanic's lien from attaching to property that was only being repaired or improved, meaning liens can now be placed on properties for repairs to existing structures. The bill also eliminates the ability for a lien claimant, the person or entity filing the lien, to file multiple lien memoranda, which are documents detailing the lien claim. Furthermore, it removes provisions that previously prohibited a lien memorandum from including sums for labor or materials furnished more than 150 days before the last work was done or materials were supplied, and it also removes the restriction on including sums for materials furnished prior to the filing of the memorandum. The bill also extends the time frame for filing a memorandum of lien from 90 days to 120 days after the last labor or materials were furnished, or after the completion of the project.
