This bill amends Arizona law to create a voluntary program allowing individuals to temporarily restrict their own firearm possession. It adds a new definition to the existing "prohibited possessor" category, which refers to individuals legally barred from owning firearms due to factors like felony convictions or mental health adjudications. The new provision allows a person to voluntarily choose to be considered a prohibited possessor and have their name added to a court-maintained list, thereby restricting their ability to purchase or possess a firearm for a period of at least 30 days and up to 180 days. To enter this program, individuals must complete a request form, which can be submitted in person to a law enforcement agency or through their healthcare provider to the court. Upon receiving the request, the court will add the person to the voluntary list, notify the national instant criminal background check system of their ineligibility to purchase firearms, and then remove them from the list and destroy related records after the voluntary restriction period ends or if they request removal after 30 days. The bill also clarifies that individuals with a concealed weapons permit will have their permit suspended while on this voluntary list but it will be reinstated upon removal, unless other reasons for suspension or revocation exist.
