This bill amends existing Utah law regarding theft of services and retail theft by clarifying definitions and adjusting penalties. Specifically, it modifies the definition of "service" in theft of service offenses to include certain utilities and telephone services obtained through specific deceptive means, and it revises the felony classifications for theft of service based on the value of the service and prior convictions, including adding a provision for felony theft of service if the actor has prior felony convictions for similar offenses. For retail theft, the bill clarifies that the intent is to deprive the merchant of the merchandise's value without paying the retail price and also adjusts the felony classifications based on the value of the merchandise and prior convictions, with similar additions regarding prior felony convictions. Additionally, the bill introduces mandatory jail sentences for individuals convicted of felony or misdemeanor retail theft who have prior convictions for similar offenses and have also been convicted of reentering the United States after deportation, preventing their release to federal immigration authorities for deportation until their jail sentence is served, with a limited exception for release within 14 days of the sentence's end. This bill is set to take effect on May 6, 2026.
