AI Summary

This bill aims to protect aquatic species, particularly coho salmon, from the harmful effects of 6PPD-quinone, a chemical byproduct of 6PPD (a tire additive that prevents cracking) that is released from tires and pollutes waterways. Starting January 1, 2035, the sale of new tires containing intentionally added 6PPD or "regrettable 6PPD substitutes" (chemicals not deemed safer alternatives) will be prohibited. To incentivize the transition to safer alternatives, a new "6PPD mitigation fee" will be imposed on the retail sale of tires containing 6PPD, starting at $3 or $6 per tire depending on load rating in 2027 and increasing by 10% annually thereafter; this fee is the responsibility of the seller and cannot be passed on to the buyer or itemized separately. The bill also establishes a new "6PPD mitigation account" to fund administrative costs, research into 6PPD-quinone contamination and its impacts on aquatic life, and other related activities. Existing tire fees will continue to fund waste tire removal and road maintenance. The bill also clarifies that penalties for violations of these provisions can be appealed to the pollution control hearings board.
