This bill modifies existing Oklahoma law regarding medical marijuana, specifically concerning employer policies and employee rights. It clarifies that employers can implement and enforce written drug and alcohol testing policies, including those that prohibit marijuana use in the workplace or during job duties, in accordance with the Standards for Workplace Drug and Alcohol Testing Act. A key change is the introduction of a "zero-tolerance drug and alcohol standard" for employees in "safety-sensitive positions," which are defined as jobs involving tasks like handling hazardous materials, operating vehicles or machinery, or providing direct patient or child care. This zero-tolerance policy applies regardless of any employer policy that might otherwise permit impairment-based testing for non-safety-sensitive roles. The bill also clarifies that employers cannot refuse to hire, discipline, discharge, or penalize an applicant or employee solely based on a positive marijuana test unless specific conditions are met, such as the individual not possessing a valid medical marijuana license, or using marijuana at work. The bill will become effective on November 1, 2026.
