This bill amends the Internet Dating Safety Act to require online dating services to conduct criminal record screenings for their members upon request and with the consent of the person being screened, specifically when one member is seeking information about another for dating, relationship, or social referral purposes. If a service does not mandate criminal background screenings for all members as a condition of using the service, it must clearly and conspicuously disclose to all New Jersey members that it does not conduct these screenings unless a member requests one and the other member consents. This disclosure must be in bold, capital letters of at least 12-point type and presented in multiple ways, such as through email notifications, on member profiles, or on the website during signup. The bill also clarifies that if a service does conduct screenings, it must state whether individuals with criminal convictions are allowed on the service and include disclaimers that screenings are not foolproof, may provide a false sense of security, and do not cover all types of records or convictions from foreign countries.
