Bill Summary
This bill would prohibit the sale, lease, rental, or other distribution, and the offering for sale, lease, rental, or other distribution, of a low-speed electric bicycle, powered mobility device, or storage battery used to power such an electric bicycle or mobility device, unless: (1) the bicycle, mobility device, or battery has been tested by a accredited testing laboratory for compliance with an appropriate Underwriters Laboratories standard or other appropriate standard established by the Department of Transportation; and (2) confirmation of the testing is displayed using a logo, wordmark, or name of the accredited testing laboratory, either on packaging or documentation that is provided to the consumer at the time of sale, rental, lease, or other distribution thereto, or directly affixed to the bicycle, mobility device, or battery. Persons who violate the bill's provisions would be subject to a written warning for a first offense and a penalty of up to $1,000 for each subsequent offense occurring no later than two years after the date of the first offense. The bill would take effect on the first day of the eighth month next following enactment.
AI Summary
This bill requires that low-speed electric bicycles, powered mobility devices (which include low-speed electric scooters and other personal mobility devices powered by batteries, but not vehicles requiring registration with the Motor Vehicle Commission), and their storage batteries must undergo testing by an accredited testing laboratory for compliance with specific safety standards, such as Underwriters Laboratories (UL) Standard 2849 for electric bicycles, UL 2272 for powered mobility devices, and UL 2271 for batteries, or other standards set by the Department of Transportation. This testing is mandatory before these items can be sold, rented, leased, or otherwise distributed to consumers. Confirmation of this testing must be displayed either on the product's packaging or documentation, or directly affixed to the item itself, using a logo, wordmark, or name of the accredited testing laboratory. Violators will receive a written warning for a first offense and face a penalty of up to $1,000 for each subsequent offense within two years of the first. This requirement does not apply to second-hand items that do not come with original packaging or documentation. The bill will become effective eight months after it is enacted.
