Bill Summary

This bill, entitled the "Transparency in Federal Enforcement Activities Act," establishes identification requirements for law enforcement officers under certain circumstances. Under the bill, a federal law enforcement operation cannot be conducted in this State or in cooperation with any State or local law enforcement agency unless all participating personnel: (1) display clearly visible identification that includes the person's name and agency of employment; and (2) verbally state their name and agency of employment upon the request of any person being questioned, detained, or arrested. The bill prohibits State or local law enforcement officers from assisting or participating in any law enforcement operation if federal agents do not comply with the bill's identification requirements. Any State or law enforcement officer who violates the bill's provisions is subject to administrative disciplinary action. In addition, the bill creates a private right of action for declaratory and injunctive relief for any person who is questioned, detained, or arrested in violation of the bill's provisions. The bill states that its provisions are not to be construed as interfering with lawful federal action and apply when State and local law enforcement agencies provide support for a federal law enforcement operation or cooperate with, or act jointly with, federal agents in this State. Under the bill, the Attorney General is to establish guidelines necessary to effectuate the bill's provisions.

AI Summary

This bill, known as the "Transparency in Federal Law Enforcement Activities Act," requires federal law enforcement officers conducting operations in New Jersey, either independently or in cooperation with state or local agencies, to clearly display their name and agency of employment and to verbally state this information upon request when questioning, detaining, or arresting someone. The bill prohibits state or local officers from participating in federal operations if these identification requirements are not met, and violations by state or local officers can lead to disciplinary action. Furthermore, individuals subjected to questioning, detention, or arrest in violation of these identification rules can sue for court orders to stop such actions. The act clarifies that it does not impede lawful federal actions but applies when state and local agencies support or collaborate with federal agents in New Jersey, and the Attorney General will issue guidelines to implement these provisions.
