Bill Summary

This bill permits substitute teachers who hold an instructional, administrative, or educational services certificate and have at least one year of continuous service in the classroom to be eligible for enrollment in the Teachers' Pension and Annuity Fund (TPAF). Under current law, substitute teachers who later become permanent or regular teachers in a TPAF-eligible position may purchase service credit in the retirement system for employment as a substitute. Otherwise, substitute teachers with at least 12 months of continuous service are enrolled in the Public Employees' Retirement System provided that other conditions have been met. In permitting certain substitute teachers to be eligible for enrollment in TPAF, this bill permits substitutes to access the benefits attendant to membership in the retirement system, such as a pension and death benefits.

AI Summary

This bill amends the definition of "teacher" within the Teachers' Pension and Annuity Fund (TPAF) to include temporary or substitute teachers who hold an instructional, administrative, or educational services certificate and have at least 12 months of continuous service, allowing them to be eligible for enrollment in the TPAF. Previously, substitute teachers generally had to become permanent or regular teachers in a TPAF-eligible position to purchase service credit for their substitute work, or they were enrolled in the Public Employees' Retirement System (PERS) after meeting certain conditions, including at least 12 months of continuous service. By expanding TPAF eligibility to these substitute teachers, this bill grants them access to benefits like pensions and death benefits associated with TPAF membership.
