Bill Summary
This bill permits a licensee or registrant who sells less than 60 stock-keeping units per month of an alcoholic beverage to retailers in this State to petition the Director of the Division of Alcoholic Beverage Control (ABC) to file only an initial current price list no later than December 15th preceding the year in which the alcoholic beverage will be sold. The bill grants the director the authority to change the December 15th filing date or establish multiple filing dates during the first year following the bill's effective date. Currently, ABC requires a current price list to be filed monthly regardless of the number of stock-keeping units of an alcoholic beverage sold per month. Under the bill, a price list filed by a licensee or registrant who continues to sell less than 60 stock-keeping units per month remains in effect until the licensee or registrant files an amendatory current price list. If the alcoholic beverages listed or the price of alcoholic beverages change, the licensee or registrant is to file with the director an amendatory current price list no later than the 15th day of the month preceding the month in which the change will take effect. The bill further requires the director to permit electronic filing of an initial or amendatory price list within 18 months following the bill's enactment. Finally, the bill removes from current law a provision requiring the holder of a limited brewery license or distillery license to provide a tour of the facility when selling the brewery's or distillery's respective products for consumption on the licensed premises.
AI Summary
This bill modifies certain requirements for alcoholic beverage licensees regarding price list filings and removes a tour requirement for limited breweries and distilleries. Specifically, it allows licensees or registrants selling fewer than 60 stock-keeping units (individual product types) of an alcoholic beverage per month to retailers to file an initial price list only once a year, by December 15th of the preceding year, with the Director of the Division of Alcoholic Beverage Control (ABC), though the director can adjust this date. If prices or products don't change, the filed price list remains valid until a new one is filed, which must be done by the 15th of the month before the change takes effect. The bill also mandates that the ABC permit electronic filing of these price lists within 18 months of the bill's enactment. Additionally, it eliminates the requirement for holders of limited brewery or distillery licenses to provide a tour of their facility when selling their products for on-site consumption.
